2) Scope and acceptance

These Terms apply to purchases made through wheelycooltees.com by consumers (B2C). By accessing the website, creating an account, or placing an order, you agree to these Terms and to the policies referenced below.

Mandatory consumer protection laws in your country of residence may apply and are not excluded by these Terms.

4) Access, eligibility, and accounts

You must be at least the age of majority in your jurisdiction to make purchases. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Account information you provide must be accurate and up to date.

5) Products, images, sizing

Product images are illustrative. Colors may appear differently depending on your screen settings. Minor variations in color, placement, and size may occur due to normal production and material tolerances.

Please check the Size Guide before ordering. If you are unsure between sizes, consider sizing up.

6) Prices, currency, taxes

You’ll be charged in your selected currency. Some banks may apply an additional fee for international purchases. Please check with your card issuer. Shipping costs and any discounts are calculated at checkout before you confirm payment.

VAT note (Italy): sales are carried out under the Italian flat-rate scheme (regime forfettario), therefore VAT is not charged and is not shown separately pursuant to Art. 1, paragraphs 54–89, Law 190/2014.

For deliveries outside the EU (and other cases where applicable), customs duties, import taxes/VAT, and carrier clearance fees may apply and are the customer’s responsibility, unless explicitly stated otherwise at checkout.

7) Orders, contract formation, and cancellations

Placing an order constitutes an offer to purchase. The contract is formed when we send an order confirmation/acceptance email (or when the goods are dispatched, depending on payment verification and risk checks).

Orders enter processing quickly. If you need to change or cancel an order, contact us immediately at support@wheelycooltees.com. We will try to help, but changes/cancellations are not guaranteed once processing has started.

We may refuse or cancel an order in cases such as suspected fraud, payment issues, address problems, product unavailability, or obvious pricing/technical errors. If we cancel after payment, you will be refunded.

Purchases are intended for personal or household use (including gifts) and not for commercial resale.

8) Payment methods

Available payment methods are displayed at checkout and may include credit/debit cards, PayPal, Apple Pay, Google Pay, and other methods enabled on the store. We do not store full payment card details.

9) Processing, shipping, delivery, and tracking

Processing begins on the next business day after your order is placed. Typical processing time is 3–5 business days, and may take up to 10 business days during holidays and peak periods.

Shipping costs, free-shipping thresholds (if any), and estimated delivery times are shown at checkout and detailed in our Shipping Policy. Delivery estimates are not guarantees and may vary due to peak periods, carrier delays, remote areas, or customs processing.

Tracking: you’ll receive a tracking link by email once your order ships (where available).

Address accuracy: you are responsible for providing a complete and correct shipping address. If a shipment is returned due to an incorrect/insufficient address or failed delivery attempts, additional shipping costs may apply for re-shipment.

Risk of loss passes to you when you (or a person you designate) take physical possession of the goods, except where mandatory law provides otherwise.

10) Returns, refunds, and withdrawal

Our Return & Refund Policy explains how returns and refunds work, including eligibility requirements and how to start a return. In summary, we offer a 30-day return window from delivery for eligible items, including change-of-mind returns for apparel and mugs, with free returns as described in the policy.

If your item arrives defective, damaged, or incorrect, you are covered and can request either a full refund or a free replacement/exchange, as described in the Return & Refund Policy.

Refund timing: once we’re informed of your decision to return/withdraw, refunds are issued without undue delay and no later than 14 calendar days. We may withhold the refund until we receive the returned goods or you provide evidence that they have been sent back.

10.1) Statutory right of withdrawal (EU/EEA & UK consumers)

If you are a consumer in the EU/EEA or the UK, you generally have a statutory right to withdraw from a distance purchase within 14 days of delivery, subject to legal exceptions. This statutory right is included within our 30-day return policy.

10.2) Exceptions

Gift cards are non-returnable. Additional exceptions may apply where permitted by law (for example, goods clearly personalized to your specifications).

11) Legal guarantee of conformity (EU consumers)

If you are a consumer purchasing goods in the EU, you benefit from a legal guarantee of conformity. This guarantee applies regardless of (and in addition to) our Return & Refund Policy and cannot be excluded or limited for consumers.

12) Intellectual property

All designs, logos, graphics, mockups, text, and images on wheelycooltees.com are protected by intellectual property laws. Any reproduction, copying, modification, or commercial use without written permission is prohibited.

13) Optional tools

We may provide access to tools or services offered by third parties. Such tools are provided “as is” and “as available”. We do not control these third-party tools and are not responsible for your use of them. Your use of third-party tools may be subject to the provider’s terms.

The website may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third parties. Accessing third-party sites is at your own risk.

15) Feedback and user content

If you submit reviews, comments, suggestions, or other content (“Feedback”), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, publish, and display such Feedback for operating and promoting the store, subject to applicable law. You confirm you have the rights to submit the Feedback and that it does not violate third-party rights or law.

Occasionally, information on the website may contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, delivery estimates, or availability. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order). If we cancel after payment, you will be refunded.

17) Acceptable use and prohibited uses

You agree not to misuse the website. Prohibited activities include, without limitation: unlawful use; attempting unauthorized access; interfering with security or operation; transmitting malicious code; scraping at scale; infringing intellectual property; or any conduct that harms the website, customers, or our rights. We may restrict access where necessary for security and legal reasons.

18) Termination

We may suspend or terminate access to the website or an account where necessary to protect the website, customers, or our rights, or where there is a breach of these Terms. Termination does not affect obligations that by their nature should survive (e.g., intellectual property, liability limitations, dispute terms).

19) Limitation of liability

Nothing in these Terms limits liability where it would be unlawful to do so, including for mandatory consumer rights. Subject to the foregoing, to the maximum extent permitted by law, our total liability for any claim related to your order will not exceed the total amount paid for that order.

20) Privacy and cookies

We process personal data as described in our Privacy Policy. Cookie preferences can be managed at any time via the “Cookie settings” link on the site.

21) Force majeure

We are not liable for delays or failures caused by events beyond reasonable control (e.g., carrier disruptions, strikes, natural disasters, government actions, outages). During such events, affected obligations are suspended for the duration of the event.

22) Relationship with Shopify

This store is powered by Shopify, which enables us to provide the online shopping platform. Any purchases you make in this store are made directly with Wheely Cool Tees (Skema Creations di Alessandro Maffei), not with Shopify. Shopify is not responsible for any aspect of sales between you and us.

23) Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

24) Entire agreement

These Terms and the policies referenced herein constitute the entire agreement between you and us regarding your use of the website and purchases made through it, superseding prior communications to the extent permitted by law.

25) Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign or transfer these Terms as part of a reorganization, merger, sale, or other lawful business transfer.

26) Governing law and disputes

These Terms are governed by Italian law. If you are a consumer, you may also benefit from mandatory protections and jurisdiction rules in your country of residence. Consumer jurisdiction rights cannot be waived.

27) Changes to these Terms

We may update these Terms from time to time. The version published on the website at the time you place your order applies to that purchase.
