SECTION 2 — SCOPE, ELIGIBILITY, AND ACCEPTANCE These Terms apply to consumer purchases (B2C). To place an order, you must be at least the age of majority in your jurisdiction. Purchases are intended for personal or household use and not for commercial resale.
SECTION 3 — LINKED POLICIES The following policies are incorporated into these Terms: Shipping Policy, Refund Policy, Privacy Policy, and Payments notes.
SECTION 4 — ACCESS AND ACCOUNT You are responsible for maintaining the confidentiality of your login credentials. You represent that all information provided is correct, current, and complete.
SECTION 5 — PRODUCTS, IMAGES, AND SIZING We make every effort to display products accurately. Minor variations in color, placement, and size may occur due to normal production tolerances. Please check the Size Guide before ordering. If you are unsure between sizes, consider sizing up.
SECTION 6 — PRICES, CURRENCY, TAXES, AND DUTIES The price charged is the price shown at checkout. VAT note (Italy): Sales are carried out under the Italian flat-rate scheme (regime forfettario), pursuant to Law 190/2014. As a result, VAT is not applicable and is not charged or displayed separately on your invoice. Customs and import taxes: Depending on destination, customs duties or import taxes may apply. These charges are the customer’s responsibility unless explicitly stated otherwise at checkout.
SECTION 7 — ORDERS AND CONTRACT FORMATION The contract is formed when we send an order confirmation email. We reserve the right to decline orders for legitimate reasons (fraud suspicion, unavailability, or pricing errors).
SECTION 8 — PAYMENTS Accepted methods include major credit cards, PayPal, Apple Pay, Google Pay, and Shop Pay. We do not store full payment card details.
SECTION 9 — PROCESSING AND SHIPPING Processing time is typically 2–5 business days. Delivery times are estimates and may be affected by carrier delays or customs. You are responsible for providing a correct shipping address.
SECTION 10 — REFUNDS, RETURNS & GUARANTEE
10.1 — DEFECTS, DAMAGES, AND ERRORS (Global – 30 Days) If we make a mistake, we fix it. We offer 100% refunds or free replacements within 30 days of delivery for items that arrive damaged, defective, or incorrect (wrong design, size, or color).

Returns: For verified defects, we will provide a prepaid shipping label at our expense. Items must be returned to our facility for inspection before a final refund or replacement is issued.
10.2 — GENERAL ELIGIBILITY & CONDITION To be eligible for a return or exchange under our 30-day policy (outside of our own errors), the item must be unused, unwashed, and in the same condition as received, including all original packaging.
10.3 — SIZING ERRORS & "CHANGE OF MIND" If you wish to return an item for a different size or due to a change of mind, the following rules apply:

EU & UK Customers: In compliance with local consumer laws, you have a 14-day right of withdrawal, which we voluntarily extend to a total of 30 days.

International Customers (USA, Canada & Rest of World): You have 30 days from delivery to request a return or exchange.

Logistics: All items must be shipped back to the authorized return facility provided in your return instructions.

Authorization Required: You must contact support before shipping any item. Returns sent without prior authorization or to an incorrect facility will not be accepted.
10.4 — REFUND PROCESSING Once your return is received and inspected at our designated facility, refunds will be automatically processed back to the original payment method within 10 business days.
SECTION 11 — LEGAL GUARANTEE OF CONFORMITY (EU CONSUMERS)
EU consumers benefit from the legal guarantee of conformity under applicable law. This statutory right applies to any lack of conformity existing at the time of delivery and is not limited by the voluntary return policies provided in Section 10.

SUBJECT TO MANDATORY CONSUMER LAWS, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO YOUR PURCHASE IS STRICTLY LIMITED TO THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
SECTION 19 — FORCE MAJEURE We are not liable for delays caused by events beyond our reasonable control (natural disasters, strikes, carrier disruptions).
SECTION 20 — RELATIONSHIP WITH SHOPIFY Purchases are made directly with Wheely Cool Tees, not with Shopify.
SECTION 21 — PRIVACY AND COOKIES Data is processed as described in our Privacy Policy.
SECTION 22 — TERMINATION We may suspend access to the Services or accounts in case of breach of these Terms.
SECTION 23 — SEVERABILITY If any provision is found unenforceable, the remaining provisions remain in full force.
SECTION 24 — ENTIRE AGREEMENT These Terms constitute the entire agreement between you and us, superseding prior communications.
SECTION 25 — ASSIGNMENT We may assign our rights under these Terms as part of a lawful business transfer.

If a resolution cannot be reached, you agree that any legal action shall be brought exclusively before the Courts of Como, Italy, unless mandatory consumer protection laws in your jurisdiction dictate otherwise.
